Commission Terms and Conditions

1. Acceptance of Terms

By commissioning artwork from McKenzie Gutshall Art, you agree to the terms and conditions outlined herein. These terms constitute a legally binding agreement between you (the "Client") and McKenzie Gutshall Art (the “Artist”).

2. Commission Process

2.1 Inquiry and Quotation:

Clients must submit a commission inquiry providing details of their project. The Artist will provide the Client with a written quotation based on the project specifications. This quotation includes the cost of materials, estimated hours of work, and any additional charges that may apply. Prices are subject to change based on the complexity of the project but will be agreed upon prior to the commencement of work.

2.2 Photo Provision

For commissions based on photographs, the Client must provide high quality, clear reference photos. The quality of the commissioned piece is directly related to the quality of the provided photograph. The Artist reserves the right to reject any photo that does not meet the necessary quality standards.

2.3 Payment:

A non-refundable booking fee of 50% of the total quoted price is required to secure a commission spot. The remaining balance is due upon completion of the artwork and before shipping. The artwork will not be shipped or delivered until the final payment has been received.

Payment is accepted via PayPal. Invoices are sent to the Client’s email.

2.4 Project Timeline:

The Artist will provide the Client with an estimated timeline and date for completion. This timeline varies and is dependent on current workload, the complexity of the artwork, and the size of the piece. Timeline estimations are an estimate and not a guarantee. Delays may occur due to unforeseen circumstances. The Artist will ensure regular communication with the Client to keep them up to date with their commission.

3. Artwork Ownership and Usage Rights

3.1 Ownership:

The Artist retains the full copyright to the commissioned artwork from the Client’s photo, including the right to reproduce, display, and distribute for promotional purposes. The Artist reserves the right to share on their website and social media.

3.2 Usage Rights:

Clients receive a non-exclusive license to use the artwork for personal purposes only. Commercial use or reproduction for profit requires explicit written permission from The Artist and may incur additional fees.

4. Revisions

Customizations or additions to the reference photo to be drawn should be discussed and agreed upon before the booking fee is accepted. The Artist reserves the right to refuse any revisions that were not part of the original agreement.

In an effort to reduce the need for revisions during the drawing process, reference photo accuracy with regards to color and detail are discussed prior to the Artist beginning work.

The Artist will send the Client a progress photo once enough progress has been made to see colors and features taking shape. At this time, small tweaks may be feasible.

The Artist reserves the right to make or refuse revisions at their discretion. Excessive revisions may be subject to additional charges and are determined at the discretion of the Artist.

5. Cancellations and Refunds

5.1 Client Cancellations:

If the Client terminates the commission request within 7 days of the initial booking fee payment, the booking fee will not be refunded but may be applied to future commissions. If the Client cancels the commission at any other time, the non-refundable booking fee will be retained by the Artist. Any in progress artwork from canceled commissions will be retained by the Artist.

5.2 Artist Cancellations:

If the Artist must cancel the commission due to unforeseen circumstances, the booking fee will be fully refunded to the Client.

5.3 Refunds

Refunds will not be given once the artwork has shipped to the Client. The non-refundable booking fee will not be returned except in the cases outlined above. Refunds may be considered on a case-by-case basis if the Artist is unable to fulfill the commission. This decision is up to the discretion of the Artist.

6. Communication

The Artist will respond to client inquiries promptly. The Artist will communicate with the Client throughout the commission process.

7. Confidentiality

The Artist will not disclose any confidential information shared by the client during the commission process.
